Welcome to Dreyka.

These Terms of Service (“Terms”) govern your access to and use of the Dreyka website, online store, products, and related services.

Throughout these Terms, “Dreyka,” “we,” “us,” and “our” refer to Dreyka. “You” and “your” refer to any person accessing our website or purchasing from us.

By accessing our website, placing an order, or otherwise using our services, you agree to these Terms and to any policies referenced in them.

If you do not agree with these Terms, you should not use our website or services.

1. Online Store Terms

You may use our website and purchase our products only for lawful purposes.

By placing an order, you represent that you are legally capable of entering into a binding agreement or have the permission of a parent or legal guardian where required.

You must not use our products, website, or services for any unlawful, fraudulent, abusive, or unauthorized purpose.

You must not attempt to interfere with, damage, disrupt, gain unauthorized access to, or misuse any part of our website, systems, accounts, or services.

2. Products and Product Information

We make reasonable efforts to display and describe our products accurately, including their colours, materials, sizing, measurements, features, and appearance.

However, colours and other visual details may appear differently depending on your device, display settings, lighting, or photography.

Because certain Dreyka products may be handmade, washed, printed, dyed, distressed, or otherwise individually finished, minor variations between products may occur and do not necessarily constitute defects.

Product measurements and size guides are provided as general guidance. Minor manufacturing tolerances may occur.

We reserve the right to modify, discontinue, or limit the availability of any product at any time, subject to applicable law.

3. Product Availability

All products are subject to availability.

Certain Dreyka releases may be produced in limited quantities and may sell out without notice.

Placing an item in your shopping cart does not reserve that item.

In rare circumstances, inventory errors may result in an item becoming unavailable after an order has been submitted.

If we are unable to fulfill an ordered item, we may cancel the affected item or order and issue any applicable refund.

4. Orders

Submitting an order does not necessarily mean that the order has been accepted.

We reserve the right to accept, refuse, limit, or cancel an order where reasonably necessary, including where:

  • A product is unavailable.

  • Pricing or product information contains an obvious error.

  • Payment cannot be authorized.

  • We reasonably suspect fraud or unauthorized activity.

  • An order appears to have been placed for unauthorized resale or other commercial purposes.

  • Shipping restrictions prevent fulfillment.

  • A customer has materially violated these Terms.

If we cancel an order after payment has been collected, we will refund the applicable amount to the original payment method unless otherwise required by law.

We may also limit quantities purchased per person, household, account, payment method, or order where reasonably necessary to protect product availability or prevent abuse.

5. Order Information

You agree to provide current, complete, and accurate information when placing an order.

This includes your:

  • Name.

  • Email address.

  • Billing information.

  • Shipping address.

  • Payment information.

  • Any other information reasonably required to fulfill your order.

You are responsible for reviewing your information before submitting an order.

If you discover an error after placing an order, contact us as soon as possible at support@dreyka.com.

We cannot guarantee that order information can be changed after processing or fulfillment has begun.

6. Prices and Currency

Unless otherwise stated, prices displayed on our Canadian store are expressed in Canadian dollars (CAD).

Prices are subject to change without notice before an order is placed.

The price charged for an item will be the price displayed or otherwise disclosed to you when you complete your purchase, subject to correction of obvious errors and applicable law.

Applicable taxes, shipping costs, and other charges will be displayed or calculated as required before you complete your purchase.

We do not intentionally impose undisclosed mandatory fees.

Promotions, discounts, and prices may be subject to additional conditions disclosed at the time of the promotion.

7. Payment

Payment must be made using one of the payment methods made available at checkout.

Payment services may be provided by Shopify or third-party payment processors.

By submitting payment information, you represent that you are authorized to use the payment method provided and authorize the applicable charges associated with your order.

We do not generally receive or store your complete payment card information when it is processed through third-party payment providers.

We reserve the right to cancel or delay an order where payment cannot be verified or where we reasonably suspect fraudulent or unauthorized activity.

8. Taxes

Applicable sales taxes will be charged where required by law.

The amount of tax charged may depend on your delivery location, the products purchased, and applicable tax rules.

9. Shipping and Delivery

Our processing times, delivery estimates, shipping costs, tracking procedures, and related shipping terms are described in our Shipping Policy.

Shipping and delivery dates are estimates unless we expressly state otherwise.

Delivery may be affected by shipping carriers, weather, transportation disruptions, remote locations, holidays, and other circumstances outside our reasonable control.

By placing an order, you agree to our Shipping Policy.

10. Returns, Exchanges, and Refunds

Returns, exchanges, refunds, damaged products, incorrect orders, and Final Sale items are governed by our Refund & Return Policy.

By placing an order, you agree to that policy.

Nothing in these Terms or our Refund & Return Policy limits rights that cannot legally be excluded under applicable consumer protection law.

11. Order Cancellations

If you wish to cancel or modify an order, contact support@dreyka.com as soon as possible.

We cannot guarantee that an order can be cancelled or changed once processing or fulfillment has begun.

If an order has already shipped, the applicable provisions of our Refund & Return Policy will generally apply.

12. Promotions and Discount Codes

From time to time, Dreyka may offer promotions, giveaways, discounts, discount codes, or other promotional offers.

Unless otherwise stated:

  • Promotional offers cannot be redeemed for cash.

  • Discount codes cannot be combined with other offers unless expressly permitted.

  • Promotions may be limited to specified products, customers, locations, or periods.

  • Promotional codes may expire.

  • Promotions are subject to product availability.

We may cancel or refuse the use of a promotion where we reasonably believe it has been obtained, distributed, or used fraudulently or contrary to its stated conditions.

Any specific promotional terms disclosed with an offer will also apply.

13. Gift Cards

Where Dreyka offers gift cards, additional gift card terms may apply.

Gift cards cannot be exchanged for cash except where required by law.

Gift cards are not eligible for ordinary returns or refunds except where required by applicable law.

14. Intellectual Property

The content of our website and brand, including without limitation:

  • The Dreyka name.

  • Logos.

  • Artwork.

  • Clothing graphics.

  • Designs.

  • Product photography.

  • Videos.

  • Written content.

  • Website design.

  • Graphics.

  • Icons.

  • Branding elements.

is owned by or licensed to Dreyka and may be protected by copyright, trademark, and other intellectual property laws.

Access to our website does not grant you ownership of or a licence to commercially use our intellectual property.

You may not copy, reproduce, modify, distribute, sell, publish, commercially exploit, or create derivative works from our protected content without our prior written permission except where permitted by law.

15. Prohibited Uses

You may not use our website or services:

  • For unlawful or fraudulent activity.

  • To violate the rights of Dreyka or another person.

  • To infringe intellectual property rights.

  • To distribute malware or malicious code.

  • To attempt unauthorized access to systems or accounts.

  • To scrape or systematically extract website content for unauthorized commercial purposes.

  • To submit false or misleading information.

  • To interfere with website security.

  • To impersonate another person.

  • To engage in payment fraud or chargeback abuse.

  • To harass, threaten, or abuse our employees, contractors, customers, or representatives.

We may restrict or terminate access where we reasonably believe these Terms have been violated.

16. Reviews, Feedback, and User Content

If you voluntarily submit a review, photograph, comment, suggestion, feedback, or other content to Dreyka, you confirm that you have the right to provide that content.

You remain responsible for the content you submit.

You must not knowingly submit content that:

  • Infringes another person's rights.

  • Is fraudulent or deliberately misleading.

  • Contains malicious software.

  • Is unlawful.

  • Contains confidential information you are not authorized to disclose.

Where you submit content specifically for publication on our website or social channels, you grant Dreyka a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, and distribute that content for the purposes for which it was submitted, subject to applicable law.

17. Third-Party Services

Our website may use or link to third-party services, including Shopify, payment processors, shipping carriers, social media platforms, analytics providers, and other service providers.

Third-party services may be governed by their own terms and privacy policies.

We are not responsible for the independent acts, content, availability, or policies of third parties except to the extent responsibility cannot legally be excluded.

18. Shopify

Our online store is hosted by Shopify.

Shopify provides the ecommerce platform that allows us to offer products and services to you.

Certain aspects of your interaction with our store may therefore also involve Shopify's systems, technologies, payment services, cookies, or other services.

Shopify's own terms and privacy practices apply to Shopify's services where applicable.

19. Privacy

Our collection, use, disclosure, and protection of personal information is described in our Privacy Policy.

By using our website, you acknowledge that personal information may be processed as described in that policy and as otherwise permitted or required by applicable law.

20. Errors and Inaccuracies

Occasionally, our website may contain typographical errors, inaccuracies, or omissions relating to:

  • Product descriptions.

  • Product availability.

  • Pricing.

  • Promotions.

  • Shipping.

  • Sizing.

  • Images.

  • Other store information.

We may correct errors or update information where reasonably necessary.

If an error affects an order you have already placed, we will handle the situation in accordance with applicable law and will contact you where appropriate.

Nothing in this section gives us the right to engage in misleading pricing or advertising practices.

However, we do not guarantee uninterrupted or error-free access.

To the maximum extent permitted by applicable law, our website and related online services are provided on an “as available” basis.

We do not guarantee that the website will always operate without interruption, delay, error, or technical problems.

Nothing in these Terms excludes, restricts, or modifies any warranty, condition, right, or remedy that cannot legally be excluded under applicable consumer protection or other laws.

23. Limitation of Liability

To the maximum extent permitted by applicable law, Dreyka will not be responsible for indirect, incidental, special, or consequential losses arising solely from your use of, or inability to use, our website or services where such liability may lawfully be excluded.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by law.

Nothing in this section limits your statutory consumer rights or our responsibilities for products, orders, refunds, or other matters where applicable law requires otherwise.

24. Indemnification

To the extent permitted by law, you agree to be responsible for losses, liabilities, damages, or reasonable costs suffered by Dreyka as a direct result of your unlawful conduct, fraud, intentional misconduct, or material violation of these Terms.

This provision does not apply to ordinary consumer use of our store and does not limit rights or protections provided by applicable law.

25. Events Outside Our Control

We will not be responsible for delays or failures caused by circumstances outside our reasonable control to the extent permitted by law.

These circumstances may include severe weather, natural disasters, labour disruptions, transportation interruptions, carrier disruptions, power or internet outages, governmental actions, emergencies, or failures of third-party infrastructure.

This section does not remove any refund, cancellation, or other rights available to you under applicable law.

26. Consumer Rights

Nothing in these Terms is intended to waive, restrict, exclude, or replace any rights or remedies that cannot legally be waived under applicable consumer protection laws.

If any part of these Terms conflicts with a mandatory legal right available to you, the applicable legal requirement will take priority.

27. Governing Law

These Terms and your use of our services are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without limiting any mandatory consumer protections that may apply to you based on applicable law.

28. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or removed where necessary.

The remaining provisions will continue in effect.

29. No Waiver

If we do not immediately enforce a provision of these Terms, that does not mean we waive our right to enforce it later.

30. Entire Agreement

These Terms, together with our Privacy Policy, Refund & Return Policy, Shipping Policy, and any other policies or terms expressly incorporated into them, form the agreement governing your use of our online store and services.

31. Changes to These Terms

We may update these Terms from time to time to reflect changes to our business, products, services, technology, policies, or legal obligations.

The updated Terms will be posted on this page with a revised “Last updated” date.

Changes will apply prospectively unless otherwise permitted or required by law.
